Why Was I Sent This Notice?

You have received a notice because DoorDash’s records indicate that you are a Settlement Class Member. The notice is designed to inform you of how you can claim a share of the Settlement payment or opt out and exclude yourself from the Settlement.

Plaintiffs claim they and others who used the DoorDash platform to complete deliveries have been improperly classified as independent contractors by DoorDash. DoorDash denies Plaintiffs’ allegations and instead contends that those who used the DoorDash platform to complete deliveries were correctly classified as independent contractors.

What Is This Lawsuit About?

Plaintiffs allege those who delivered through the DoorDash platform have been improperly classified as independent contractors by DoorDash.

DoorDash denies they have done anything wrong and believes those who used the DoorDash platform to complete deliveries were correctly classified as independent contractors. The court has not decided if DoorDash has done anything wrong.

Who is Included in The Settlement

The Marko v. DoorDash, Inc. Settlement consist of two sub-classes. The California Settlement Class and the Massachusetts Settlement Class.

The California Settlement Class: All individuals who entered into an agreement with DoorDash to use the DoorDash mobile application to offer delivery services to customers in California from August 30, 2016 through December 31, 2020, and performed at least one delivery in California from August 30, 2016 through December 31, 2020. The California Settlement Class excludes all such individuals who have entered into separate settlement agreements with DoorDash to settle and release all of their misclassification-related claims for the same time period.

The Massachusetts Settlement Class: All individuals in Massachusetts who entered into an agreement with DoorDash to use the DoorDash mobile application to offer delivery services to customers in Massachusetts from September 26, 2014 through March 31, 2021, and performed at least one delivery in Massachusetts from September 26, 2014 through March 31, 2021.

What does the Settlement provide?

The Settlement Fund is $100,000,000. After certain deductions are made, this will be the source for payments to Class Members who timely submit a valid Claim Form.

How are the Payments Calculated

Payments will be calculated proportionally based on miles driven or traveled while completing deliveries through the DoorDash application. No one who submits a valid claim form will receive a payment less than $10.

How do I submit a claim?

The easiest way to submit a claim is electronically here on the website Online Claim Form. You will need your unique Claimant ID and Control Number that was sent to you by email.

When do I need to submit a claim form to be part of this Settlement?

The deadline to submit a valid claim form is November 1, 2021.

What if I do not turn in a claim form?

If you do not submit a valid claim form by November 1, 2021 you will give up rights that you may have, if any, to pursue claims against DoorDash and you will also not receive payment.

What if I lost or misplaced my electronic or physical notice with the Claimant ID and Control Number?

If you lost or misplaced your Claimant ID and Control Number you may contact the Settlement Administrator at info@doordashclasssettlement.com.

How do I exclude myself from the Settlement (Opt-Out)?

If you do not want to be bound by the Settlement and release of claims against DoorDash, you may submit a written Request for Exclusion or “Opt-Out” from the Settlement to the Settlement Administrator postmarked no later than November 1, 2021.

To request exclusion, you must submit a written request and it must include: (1) your name, address, and telephone number; (2) a clear and unequivocal statement that you wish to be excluded from the Settlement Class; and (3) your signature. Alternatively, you may email your request from your DoorDash Dasher email account to info@doordashclasssettlement.com. If you email your request from another email account, you must attach your written request as a PDF attachment which includes your “wet” signature. Email signature alone is not sufficient.

What is the deadline to exclude myself from the Settlement (Opt-Out)?

If you want to file an exclusion (opt-out) to the proposed Settlement, you must do so in writing on or before November 1, 2021.

When and where will the Court decide whether to approve the Settlement?

The Final Approval Hearing is on November 30, 2021 at 9:30 a.m. Pacific Time. It will be held at the Los Angeles County Superior Court. You do NOT have to attend the hearing.

What if the Settlement does not get approved?

If the court denies approval of the Settlement no Settlement payments will be made.

Payments

When can I expect my Settlement payment?

If the Court approves the Settlement, and you have filed a timely valid claim, payments are estimated to be made around March 2022. However, please know there can be delays, so this is an estimated date only.

How can I receive my Settlement payment?

You can receive your Settlement Payment electronically via PayPal, Venmo or Zelle or by paper check sent through the mail.

What happens if I submit a claim by mail, but want to receive the Settlement payment electronically?

You can only receive an electronic payment by submitting your Online Claim Form

How do I receive a Settlement payment if I submitted a claim by mail?

A paper check will be sent to the address you provided on your Claim Form if you submitted a timely valid claim.

What if I want to receive my Settlement payment electronically?

To receive a Settlement payment electronically you are required to submit a claim form online. The Settlement payment can be sent out via PayPal, Venmo, or Zelle. On the electronic claim form you must provide your email address, phone number and select your preferred electronic payment method.

What if I need to update my address or contact information?

To update your address or contact information please contact the Settlement Administrator by email at info@doordashclasssettlement.com.

Will my Settlement payment be reported to the IRS?

If you file a timely claim and your payment is $600 or more, your Settlement payment will be reported to the applicable governmental authorities on IRS Forms 1099. You are solely responsible to pay all taxes, interest and penalties on all Settlement payments you receive. Neither the Parties, their counsel, the Settlement Administrator, nor the Court is providing you with any tax or financial advice. You should consult with your accountant or tax preparer with any questions regarding your Settlement payment.
